General Terms & Conditions
These General Terms and Conditions of Sale regulate the offer and sale of products on the e-commerce Website www.mymami.it (“Website”) to customers who reside and indicate as address a delivery area situated in a Member Country of the European Union.

General Conditions of Sales regulate the purchase of products on the Site for people (“CUSTOMER”) which are “Consumers” as defined in the Italian Consumer Code.
The General Conditions of sale may be altered at any time. Any alterations and/or new conditions shall come into force from the moment of publication on the Site.
In accordance with Legislative Decree n. 185/1999 containing provisions related to electronic commerce (e-commerce), TAM s.r.l. hereby informs the customer , before proceeding with the transmission of the order form, can identify and correct any errors in the insertion of data and shall accept the General Conditions of sale;
once the order form has been registered, TAM s.r.l. shall confirm it tacitly, otherwise shall not confirm it within 5 days with a message.
By placing an order using one of the various methods available, the CUSTOMER declares that they have read all the indications provided during the purchase procedure and that they fully accept the General Terms and Conditions of Sale. Once the online purchase procedure is complete, the CUSTOMER must print or save an electronic copy of these General Terms and Conditions of Sale, and in any case keep them safe, in accordance with articles 3 and 4 of (Italian) Legislative Decree no. 185/1999 concerning distance selling.
TAM s.r.l. is a virtual retailer whose commercial offering is based on goods from its own stores as well as goods whose availability is based upon communications from its own suppliers. The Site is automatically updated continuously to ensure the best match between the availability provided by suppliers and the one published on the Site. Some Products may no longer be available after transmission of an order, including when different users purchase the same Product at the same time. In this case the CUSTOMER will be immediately informed by e-mail, the order will be cancelled and the total amount paid, including delivery and any other costs for that order, will be refunded to the CUSTOMER who paid .
Once the order form has been received, TAM s.r.l . will send an e-mail of confirmation to the CUSTOMER, at the indicated e-mail address, containing the following: a summary of the General Conditions of Sale, the number of the order, the information regarding the basic features of the purchased product, a detailed indication of the price, the form of payment used, the delivery expenses and any additional expenses.
The message also indicate all the customer information. The CUSTOMER is responsible for the accuracy of that information and for promptly communicating any changes.
All the prices of the Products published on the Site are expressed in Euro and are inclusive of Value Added Tax.
Credit card, Stripe, Pay Pal, Apple Pay:
When making the payment for your order by credit card, you will be directly forwarded to a secure page (SSL) of the Bank responsible for completing the transaction (payment gateway website). On this page, you can enter all your credit card details with total peace of mind.
If the payment is successful, you will receive instant confirmation and the only thing the bank sends us is a receipt number. The online transaction is completely secure due to the fact that nobody apart from the bank in charge of the transaction will have knowledge of your Credit Card codes.

In certain cases, our Customer Service department may contact the CUSTOMER to request further information intended to determine the legal owner of the credit card.
On your credit card statement, will be shown TAM s.r.l. store.
Any time a contract is terminated and the order subsequently cancelled, prior the amount has been effectively charged on your credit card, we will request to the Bank the release of the amount "held". The release time will depend exclusively on your credit card issuer and, for certain cards, may reach its natural expiry deadline.
Once the credit card issuer has been asked to release the reserved amount TAM s.r.l. cannot under any circumstances be liable for any damages, direct or indirect, due to the delay in the banking system to release the reserved amount.
To guarantee the safety of payments made through the Site and to prevent fraud, TAM s.r.l. reserves the right to ask for additional customer information and to not confirm the order.
Bank transfer: Should the CUSTOMER opt to pay for the goods ordered via bank transfer, then said goods shall be withheld until proof of payment has been provided. This confirmation of payment must be sent to TAM s.r.l. (via e-mail) no later than three working days after the order is accepted. Orders shall be considered accepted once the relative bank transfer has been received and no later than five working days from receipt of the order. The goods ordered shall only be dispatched once the amount due has been credited to the bank account held by TAM s.r.l. After this deadline, the order shall be automatically cancelled. The order reference number must be indicated in the description of the bank transfer.
Deliveries shall be made within five working days from when payment is duly received, without prejudice to cases of force majeure. Goods will be delivered “at street level”. Once the courier has delivered the goods, the CUSTOMER is obliged to check that the number of packages delivered corresponds to the number indicated on the transport document sent in advance via e-mail. The CUSTOMER must also check that the packaging is intact and is not damaged, wet or altered in any way, also with reference to the materials used to seal the package (adhesive tape or metal straps). Any damages to packaging and/or the Product or mismatches with the number of packages or other indications must be immediately reported, stating SUBJECT TO CHECKS in writing on the courier’s delivery receipt and specifying the reason for this reservation. Once the courier document has been signed, the CUSTOMER may no longer raise any objections regarding the external characteristics of the goods delivered. Any problems with the physical integrity, quantity or completeness of the Products received must be reported within seven days from their delivery.
Should material be held in the courier's depot, as a result of repeated failed attempts to make the delivery to the address indicated by the CUSTOMER as part of the order, and this material is not collected within five working days, then the goods ordered shall be sent back to the TAM s.r.l. warehouse and the CUSTOMER shall be made to pay any relative surcharge.
Exemption from liability
The image that comes with the Product description may not perfectly represent its characteristics. All information provided to support purchases (description, photographs, etc.) is understood to simply be generic information and does not refer to the actual characteristics of each single Product.
The CUSTOMER waives all rights to claim compensation or reimbursements, as well as any contractual or non-contractual liability, for direct or indirect damages to people and/or things, caused by the full or partial failure to accept an order, or by delays to deliveries caused by force majeure, such as strikes or other collective bargaining actions, natural disasters, inability to use public or private transport or inability to use telecommunications systems.
Returns and Product warranty
It is possible to withdraw from the purchase contract, however returned goods shall not be accepted if they are damaged, used, without their original packaging or missing any parts or accessories. To exercise this right, please fill out the form in the dedicated section of the website within 14 days from receiving the goods. The goods may be sent to the following address only after receiving our authorisation to do so: TAM s.r.l., Via Don Bosco, 31021 Mogliano Veneto - TV - ITALY. Shipping and ancillary expenses relating to the return of goods shall be borne by the CUSTOMER. Under no circumstances may we be held liable for damage or theft/loss of goods being returned without insurance. After checking that the goods returned are intact, we shall reimburse only the value of the goods, within 14 days. The customer is solely responsible for reducing the value of goods after handling the product in a way that is not necessary to establish its nature, characteristics and functioning.
The Product may be tested or checked but it may not be used, washed or damaged; it must therefore be looked after with a normal level of care and must be returned intact, perfectly suitable for the use for which it is intended and without any signs of wear or dirt, complete in its entirety and with all the relative accessories and information leaflets, with its ID cards, labels and single-use seal, where present, still attached to the product and still intact and not tampered with.

The sale contract between the CUSTOMER and TAM s.r.l. is understood to be completed in Italy and governed by Italian law. Any disputes relating to the application, implementation and interpretation of these General Terms and Conditions of Sale shall fall under the jurisdiction of the court where the customer resides, or where it has appointed its address for service, as defined by the Consumer Code. The CUSTOMER shall also have the right to follow the online dispute resolution procedure, available from http://ec.europa.eu/consumers/odr/
